FAQ

All about buying property in Pattaya

  • Will the unit be owned by me?
  • By Thai Law, 49% of each condominium is designated as Foreign Owned and 51% Thai name / Company owned. That means that units under that designation in any given project can be owned 100% by a foreign national under their name with full legal protection.
  • Can one apartment have several owners?
  • Yes, it is possible to have several names listed as the property owners. All must be either present during the purchase/sale of the unit or have a valid Power Of Attorney on their behalf. All owners must be over the age of 18.
  • If I bought a unit under a developer payment plan, will I lose the unit and money paid already if I am unable to continue with my payments?
  • Not necessarily, if you’ve realized you are unable to continue paying for any reason, the contract can be resold and the developer will take a minor fee to change the name of the contract owner. The price at which the contract is sold can be also negotiated.
  • If something happens to me how does inheritance work in Thailand for New Developments?
  • In the unfortunate case when the owner is no more, the first thing that is established is whether or not there is an existing will. If there is a will the new owner can take over the contract within 2 weeks and make a conscious decision whether to continue to make payments or put the contract up for sale. If there is no will then there will be court procedures that usually last about 6-9 months and up to a year where all valid claims will be heard.
  • What are the expenses I have to consider besides the purchase price?
  • If you are buying a unit under construction with a payment plan at the end you should expect additional meter installation fees (to change to government meters for cheaper electricity and water) and a Sinking fund (At Grand Solaire it is a one-time payment of 500THB/SQM). Also, there might be an additional legal fee by the developer for the transfer of the unit into your name.
  • What expenses should I expect after I bought the unit?
  • In Thailand, maintenance bills are paid once a year, at the beginning of the reporting year. The cost is 30-50 THB/SQM per month paid 12 months in advance. This money is used to keep the condominium running, minor repairs, and staff salaries.

    There is also a city toll/tax paid once a year, but currently, for most units, it is below 500 THB / Year.

  • Is a parking space included in the price of the apartment?
  • By law, each condominium must build a parking lot on at least 30% of the apartments, and each tenant has the right to use it free of charge, provided there are no utility bills.

    Individual parking spots are very rare in Pattaya.

  • Can I rent out my apartment in the future?
  • Of course, you can legally rent out your property for a period of one month, and so on. Some condominiums do allow shorter rentals, but that is becoming rare.
